These Terms and Conditions of Sale define the conditions under which the Provider offers, via the website eta-uk-apply.com, an administrative assistance service for Electronic Travel Authorisations (ETA) and electronic visas (eVisa).
2. Nature of the Service
The customer expressly acknowledges that:
- eta-uk-apply.com is a private, independent service
- The Provider is not a governmental authority
- The service consists solely of administrative assistance
- The Provider acts as a technical intermediary for document preparation and submission
No guarantee of approval is provided for any ETA or eVisa application.
The final decision remains solely with the competent authorities.
3. Acceptance of Terms
The customer confirms that:
- They have read and understood these T&Cs before placing an order
- They understand the nature of the service provided
- They fully accept these terms without reservation
Acceptance is validated through a mandatory checkbox prior to payment, which constitutes an electronic signature.
4. Orders and Payment
Any order is considered final upon payment confirmation.
The payment corresponds to an immaterial service that begins immediately after validation.
The customer agrees that processing may begin immediately after payment.
Accepted payment methods are those displayed on the website.
5. Waiver of Withdrawal Right
In accordance with Article L221-28 of the French Consumer Code, the customer expressly acknowledges that:
- The service begins immediately after payment
- They waive their right of withdrawal
This waiver is confirmed via a mandatory checkbox before validation.
6. Customer Obligations
The customer agrees to:
- Provide accurate, complete, and up-to-date information
- Submit clear and valid documents
The customer is solely responsible for any incorrect or incomplete information.
Common causes of refusal may include:
- Non-compliant photo
- Expired or unreadable passport
- Inconsistent information
- Missing data
- Fraudulent documents
7. Document Submission
The customer must submit all required documents within the requested timeframe.
Any delay or missing documents may result in processing delays or refusal, without liability of the Provider.
8. Application Processing
Processing begins upon receipt of:
- Payment confirmation
- Required documents and information
The Provider reserves the right to:
- Reject incomplete applications
- Suspend processing in case of suspicion of fraud or inaccurate data
9. Application Refusal
The customer acknowledges that an application may be refused for reasons beyond the Provider’s control, including:
- Government decision
- Ineligibility
- Errors or inconsistencies in the application
Final decisions are made exclusively by the competent authorities.
10. Refund Policy (Essential Clause)
The customer acknowledges that payment covers a personalized administrative service that begins immediately after validation.
Once payment is received, the Provider performs work including:
- Application review
- Information verification
- Administrative preparation
Therefore, no refund will be issued, including in cases of:
- ETA or eVisa refusal
- Incorrect information
- Missing documents
- Abandoned application
- Change of mind
The customer expressly waives any refund request once the service has started.
11. Fraud Prevention and Disputes
Any abusive dispute, fraud attempt, or unjustified chargeback may result in:
- Submission of all evidence (orders, IP logs, emails, documents) to financial institutions
- Legal proceedings
Electronic records (emails, logs, validations) are accepted as legal evidence.
12. Liability
The Provider cannot be held responsible for:
- Government decisions
- Application refusal
- Customer errors
- Travel cancellations or financial losses
The Provider’s liability is strictly limited to the amount paid for the service.
13. Personal Data
Data collected is necessary for processing applications.
It is handled in accordance with applicable GDPR regulations and is not sold or shared with unauthorized third parties.
Customers have the right to access, modify, and delete their personal data.
14. Proof
Stored data (emails, payments, IP addresses, validations) constitutes valid legal evidence between both parties.
15. Governing Law and Jurisdiction
These Terms and Conditions are governed by French law.
Any dispute shall be submitted to the competent courts within the jurisdiction of the Provider’s registered office.
